7. Disclaimers
The site is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. 8. Limitation of liability
To the maximum extent permitted by law, Brevor, its affiliates, officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the site.
Brevor's aggregate liability for any claims arising out of or relating to these Terms or the site will not exceed one hundred United States dollars ($100).
9. Indemnification
You will indemnify and hold Brevor and its affiliates harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your misuse of the site; (b) your violation of these Terms; or (c) your violation of any third-party right.
10. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
Customers under signed agreements with Brevor are bound by the dispute-resolution terms of those agreements, which supersede this section as to the subject matter of the deployment.
